The 4-3 decision last yesterday by the state supreme court to not consider until after the election Congressman Mark Green's appeal of the state elections board decision regarding $467,844 in disputed campaign funds reminds us just how precariously balanced the state supreme court is.
Liberals Chief Justice Shirley Abrahamson and Justices Ann Walsh Bradley and Louis Butler are as predictable as their more conservative counterparts Justices David Prosser, Jon Wilcox and Patience Roggensack. The wildcard is state supreme court justice Pat Crooks who once again sided with the liberals on the court. Making the balance of the court even more at risk, Wilcox is not running for re-election, opening up the possibility we could end up with a solid liberal majority not dependent on the wavering Crooks.
Issues like parental consent to an abortion, gay marriage, school choice could all be upset in the next couple of years.
By the way, because the court has decided to delay making any real decision in the Green case until after the election, what happens if they rule in his favor? Does he get an apology?
