The Journal Sentinel is reporting the city of Delafield may have violated the law when the common council tried to maneuver around a citizen petition to cap expenditures. Hours after a petition was filed, the common council enacted a $1.5 million cap for capital expenditures and put in possible exceptions, all different from the intent of the petition which could have put a lower cap up for referendum.
So far the state elections board has stated the petition must be acted on, and Wakesha DA Paul Bucher has said Delafield violated the open meetings law by failing to post notice. Despite this, Delafield has taken no action on the Bucher letter stating the law is "null and void", according to the Lake Country Reporter.
It looks like the whole issue will end up in court.
